Update on US Reciprocal Tariffs

In a November 14 Executive Order, the United States removed the reciprocal tariffs for HTSUS 2915.90.10 (Fatty acids of animal or vegetable origin) and HTSUS 2916.19.50 (Unsaturated acyclic monocarboxylic acid anhydrides, halides, peroxides, peroxyacids and their derivatives) when used as non-patented articles in pharmaceutical applications. Both of these codes were in the April 2 Annex II list, which exempted them from reciprocal tariffs; however, on September 5, 2025, President Trump, in Executive Order 14346, modified the scope of products subject to the reciprocal tariffs imposed under Executive Order 14257, and issued an updated version of Annex II, which included both HTSUS 2915.90.10 and HTSUS 2916.19.50. The latest Executive Order reverses the September decision and adds these two codes back to the exempt list.

 

Both of these codes were also included in our May 7, 2025 letter to the US Department of Commerce Requesting Tariff Exemptions for Omega-3 Oils. While neither code was associated with a reciprocal tariff at the time we submitted our letter, we included them as a pre-emptive measure to stress their importance to the omega-3 industry.

GOED Provides Feedback on DHA Safety to EFSA

GOED has provided feedback in response to the European Food Safety Authority’s (EFSA) Draft scientific opinion on the safety of supplemental docosahexaenoic acid (DHA). As reported in the October 6, 2025 GOED Current, at this point EFSA has maintained its 2012 safe level of intake of one gram/day of DHA for all population groups, based on the possible risk of spontaneous bleeding/bleeding complications.

 

After reviewing the draft scientific opinion, GOED determined that the only impact we could have on EFSA’s conclusion was to identify studies using more than one gram/day of DHA that included measurements of spontaneous bleeding/bleeding complications. Using the Clinical Study Database (CSD), GOED identified (and subsequently provided to EFSA) three relevant studies providing 1200-1900 mg/day of DHA that don’t appear in the draft scientific opinion, with the hope that a higher safe level of intake will be considered.   

 
EU Member States Vote on MOAH Regulation Postponed 

The vote on the proposed regulation of mineral oil aromatic hydrocarbons (MOAH) in the European Union (EU), which was scheduled for November 19 during the meeting of the European Commission Standing Committee on Plants, Animals, Food and Feed (SCoPAFF) committee, has been postponed until December 15. While the reasons for postponement are unknown, it appears that there are still points of discussion and different views by Member States (MS), particularly about the setting of maximum limits (MLs) for crude unrefined oils.

 

As background, in its previous meeting on September 19 (the minutes for which just became available), the SCoPAFF committee discussed the proposal and several MS presented their viewpoints that crude oils should be exempt from the MLs for MOAH, because it is possible to remove MOAH via refining processes. The EC wants limits on crude edible oils and fats to ensure good practices throughout the whole supply chain and to prevent mixing contaminated and non-contaminated oils; however, it was explained that MS have the option to allow refinement of non-compliant foods entering the EU on the basis of Articles 66 and 67 of the Official Controls Regulation.

 

According to the minutes from the September meeting, another MS stated that a lower ML for MOAH in food supplements for infants and young children should be proposed; however, the EC explained that this would be difficult due to the variety of food supplements and analytical challenges, and suggested after a few years this request could be reconsidered.

 

The original proposal being discussed can be found in the June 12, 2025 News Alert and June 23, 2025 GOED Current. However, it is plausible that in the December 15 meeting an updated proposal may be introduced. As far as we know, this vote will be decisive, and if approved, no further ratification is needed for any MLs to take effect. GOED will keep members informed as soon as we learn more about the outcome of the December 15 meeting, or any updated proposal.
